Rental terms and conditions
General Terms and Conditions of Rental (as of 15 August 2019)
1. The sole contractual partner of Radstation® Münster is the renter designated above who, upon conclusion of the contract, shall also assume liability for all accompanying persons using a rental bicycle and who shall be responsible for paying the (total) rental price due.
2. The agreed rental prices, which are publicised in a notice, must be paid in cash at the time of renting the bicycle and include the respective statutory VAT (currently 19%).
3. Before starting the journey, the renter shall be obliged to satisfy himself that the bicycle and accessories supplied to him are safe to use, and to only use the bicycle for its intended purpose in public traffic areas and on designated cycle paths. It must be parked safely and locked properly. The renter confirms that he has received sufficient instruction on how to operate the bicycle and on the safety precautions to be observed, and that he has satisfied himself that the bike and its accessories are free of defects. Later complaints relating to defects that were already apparent upon handover cannot be accepted.
4. An extension of the rental period shall only be possible after prior agreement. The rental price incurred for the extended rental period shall be charged retrospectively, based on each calendar day or part thereof. If the renter extends the rental period himself, an additional processing fee of EUR 5.00 per bike shall be charged. This shall not affect any further claims of Radstation® Münster (e.g. for securing and collecting the bicycle, replacing the bike lock, etc.).
5. If a bicycle is returned early, regardless of the reason, no refund shall be given in respect of the pro-rata rental price.
6. When the bicycle is returned, the copy of the rental agreement that is intended for the renter must be presented to enable the return to be certified on the copy, and so that any defects found on the bicycle can be documented on it.
7. Radstation® Münster shall only be liable for damage resulting from the inadequate operational safety of the bike and its parts in the event of intent or gross negligence.
8. Radstation® Münster must be informed immediately in the event of a traffic accident or other damaging event and also if the bike is lost or damaged. At the same time, the nearest police station must be contacted in order to record an accident or report a crime.
9. The renter shall be liable to Radstation® Münster for all damage that occurs to the rental bicycle after it has been handed over to him, regardless of whether the insurance of Radstation® Münster (Europäische Reiseversicherung AG, Munich) or a third party is responsible for this. Any third-party indemnifications shall be taken into account.
10. The sole place of jurisdiction for commercial parties or those who do not have a general place of jurisdiction in Germany is Münster.
11. Unless otherwise agreed, the bicycles shall be held ready for you until 2 p.m. on the first day of rental. You may reduce or cancel the order at no cost up to 5 days before the first day of rental. After this point, we charge 50% of the loss.
